TOURATURK All Inclusive Guided Tour Terms and Conditions

All our customers who book Tourturk tours through the official website of Touraturk.com and/or our agencies are deemed to have accepted all the conditions explained in this document in advance. This document has been prepared to guarantee the rights of Touraturk customers and Touraturk and is mutually agreed upon upon making the reservation.

Reservation and payment conditions

Our tour reservation is made only through our official website of touraturk.com and through our agencies. Our customers can see our authorized agents by clicking this link. 

Customers can make their reservation by PayPal, Credit Card or bank transfer at the stage of completion.


When customers complete their reservations on our website and through our agencies, a confirmation mail will be sent to the e-mail address to the customer specified in the forms. Afterwards, customers will be called by our operations manager during working hours and verbal confirmation of their reservation will be made. At this stage, all necessary information will be given to the customers verbally and necessary information will be obtained from our customers for their hotel, meal and activity reservations during the tour. Our aim is to provide our customers the most accurate service in terms of their health and comfort.


Payment and refund terms

Standard Payment - Money-back guaranteed

Our customers will have the unconditional right to cancel their tour purchases with standard payments through our official website of Touraturk.com and/or our agents, up to 8 weeks before the tour start date. When our customers use such cancellation, the entire amount they paid will be refunded to them in the same form of payment they made, without any deductions. Our customers may also want to buy from our tours on a different date by simply changing the calendar without canceling their tour. Our operations manager will also assist our customers in this regard. In this case, calendar suggestions will be made to our customers by my operations manager according to availability.

 

If customers cancel up to 4 weeks before the start date of the tour they have purchased, 20% of the amount they paid will be deducted and the payment method will be refunded to them. In this case, our customers may want to buy from our tours on a different date, without canceling their tour, simply by changing the calendar. Our operations manager will also assist them in this regard. In this case, calendar suggestions will be made to our customers by our operations manager according to availability.


If customers want to cancel their tour less than 4 weeks before the start date of the tour they have purchased, 50% of the amount they have paid will be deducted and the remaining 50% will be returned to them in the form of payment they made. In this case, our customers can make their tour at a different time by choosing one of the appropriate calendars that our operations manager will recommend to them.

If the tour is not reserved by minimum 5 riders, Touraturk will have the right to cancel the tour up to 30 days before departure. In such case, the client may be informed immediately and all amounts he has paid will be refunded to him in full. Other claims may not be submitted and will not be accepted.

Strike, pandemic conditions, terrorist attacks, emergencies, tour guide's illness or involvement in an accident, traffic accident, etc. If the tour is canceled due to reasons beyond Touraturk's control, the amount paid by the customer will be fully refunded. Cancellation requests will not be accepted.

Touraturk reserves the right to cancel this tour for the reasons listed above. In this case, a proportional refund of the tour cost covering the unpaid days of the tour will be made. Flight costs are not refundable. Cancellation requests will not be accepted.

Individual participants may be excluded from the tour by Touraturk and his authorized tour guides in case of bad discipline, dangerous or annoying behaviour during the tour, including failure to observe the traffic rules. As a result of that, the rented motorcycle shall be returned and no amounts for the tour and the use of the motorcycle will be refunded.

If our customer terminates the tour ahead of schedule due to any reason whatsoever, they may not submit any claim for the repayment of the services invoiced to him by Touraturk.

If our customer cancels/exites the tour due to a valid and acceptable reason, such as illness or accident, serious disease or death of close relative, as Touraturk we will try to assist as much as possible in the organization of the return of our customer. In this case, our customers may not submit claims for the repayment of the services invoiced by Touraturk.

Early Payment - Non-refundable

Early payment campaigns are organized for the tour programs specified on the official website of Touraturk.com. When our customers buy a tour with the early payment campaign, they cannot have the right to cancel it. If our customers cannot join the tour they have purchased, there will be no refunds. However, it may be possible to realize the tour they purchased in another week within the same year by meeting with the Touraturk operations manager. In this case, only the calendar proposed by Toraturk will be valid.


Conditions of Participation in Tours

Our guests who will use motorcycles to participate in our tours must have a minimum 2 years A class motorcycle riding license. This condition will not be required for our guests who will be on the motorcycle as a rearguard and will join our tour by making a reservation in our minibus.

Our customer’s safety and health is our first priority. As Touraturk, we take every precaution to avoid any accident. All our guests who will participate in our tours are required to have a 100% guaranteed and unlimited travel health insurance that will be valid for the duration of the tour. The insurance in question should cover the compensation of mental and physical damages that may occur due to all kinds of diseases and accidents that may occur. Touraturk operations manager will request the relevant insurance documents from our guests before the tour. Touraturk is not responsible for any health expenses that may occur in case of accident or illness for any reason. This responsibility will belong to our guests themselves. However, the Touraturk tour assistant will in any case undertake the entire organization and provide all the necessary operational support. Our tour assistant and tour guide have first aid certificates and in case of an accident, they will personally take the necessary first aid until the official first aid service arrives.

Liability for Compensation for Damages

Motorcycles rented by purchasing tours from Touraturk will be delivered to our guests in a complete and fully functional manner after checking all safety and comfort features. Our tour assistant, who uses our safety and travel experience as Touraturk's technical manager, is responsible for the work to be done so that all our motorcycles can be used safely and comfortably during the tour. Every time our tour group takes a break, it is Touraturk's responsibility to ensure the physical safety of the motorcycles, to perform function checks and to fix technical problems, if any. In addition, at the end of the tour day, when the final parking area is reached, our tour assistant will perform comprehensive function checks of all our motorcycles and will clean them, ensuring that our guests continue the new riding day with clean motorcycles.

Touraturk motorcycles are covered by the compulsory traffic insurance of the other vehicle in case the other vehicle driver/rider is found guilty, in any accident that may occur by colliding with another vehicle.

In case the rider of Touraturk's motorcycle is found to be at fault, the material damage of the vehicle on the other side is covered by the compulsory traffic insurance of the motorcycle belonging to Touraturk. However, in this case, the damage to the Touraturk motorcycle is covered by the deposit received.

Damages exceeding the amount of deposit received will be covered by Touraturk. The liability of our guests for damages caused by their own faults is limited to the deposit amount.

The conditions stated are only valid if the rider of the Touraturk motorcycle has a zero promyl alcohol level in his blood. The liability of compensation for all material and bodily damages caused by the rider of the Touraturk motorcycle, who had an accident with alcohol, belongs to the person who ride the motorcycle. In this case, the drunk rider using the Touraturk motorcycle is responsible for the damages that may occur to the vehicle of the other party or parties, the health damage that may occur and the damages that occur to the Touraturk motorcycle.

Antalya, Turkey courts will be authorized in disputes that may arise between the parties and / or third parties.

Motorcycle riding rules

Our guests who participate in our tours as motorcycle riders during the tour are obliged to comply with the following safe riding rules. However, motorcycle riders have to make a safe ride without compromising the safety of themselves, their passengers, other group riders and also other vehicles in the traffic.

All rides during the tour will be carried out within the framework of group riding rules. Motorcycles will not be used individually.

While riding, Touraturk's tour guide will form the group riding order and will inform all riders in which order they will be riding before the ride. During the rides, motorcycle riders will ride in the zip pattern, which is the safest group riding pattern. Each rider will ride by keeping a safe riding distance at the diagonal line of the rider in front of him. While riding, motorcycles will not cross over and will ride in a way that will protect their position and their own safety.

Our guests who use motorcycles in a way that threatens their own safety and group safety will be warned by the tour assistant and tour guide. Riders who continue to use dangerous motorcycles after 3 warnings will not be allowed to use their motorcycles any more and they will continue the tour in our minibus.

Riders who insist on riding a motorcycle in a way that threatens safety will not be allowed to use motorcycles, and in such a case, guests will not have the right to demand any refund. However, in this case, our guests will be able to accompany our journey in our minibus for the rest of the tour. This will not cause any change in the scope of the tour, except for the use of motorcycles.

When crossing in a group is required, the tour guide will set the distance to which the entire group can pass, and will signal and initiate the transition. All riders will take turns keeping in mind that they are responsible for their own safety and the safety of other vehicles. After the transition, all riders will take their places in the group again.

Touraturk's tour assistant will show the place to park during the breaks and our guests who are riding their motorcycles will park in the places shown to them.

After the break, the ride will start again at the time determined by the tour guide and tour assistant. All riders will be ready to ride their motorcycles at the specified time so that the ride can be resumed on time.

All riders accept and undertake that they will have zero promil alcohol while riding a motorcycle. For this reason, alcoholic beverages will not be consumed during the day until the end of the ride. Consumption of alcoholic beverages at dinner and afterwards will be limited, starting the next day with a zero bonus at the moment of riding. Every rider agrees and undertakes to start their riding day on time and with zero bonus. In case of a delay of more than 30 minutes, the group will depart and the rider will not be allowed to ride the motorcycle that day.

Penalties

The payment of traffic fines arising from the use of the drivers who use the motorcycle belonging to Touraturk belongs to the driver who violated the traffic rule. In this case, the penalty amount will be paid by using the driver's/customer's deposit.

The indemnity liability of Touraturk customers for all kinds of material or bodily damages, damages and damages they may cause to third parties, companies and/or institutions during the tour belongs to the customer who caused the damage and/or his legal representative or guardian.

In case Touraturk customers enter into a legal conflict with third parties, persons and institutions and the Republic of Turkey for any reason, court and attorney expenses etc. that may arise. The legal expenses and any compensation responsibilities that may arise against the government and other third parties belong to the customer who caused the contention. Touraturk is not liable for any compensation in this regard.

Other Responsibilities

Our tours officially start on Sunday when our customers are picked up from the airport by transfer and transferred to the hotel. Sunday is the transfer day of Touraturk tours. Driving starts on Monday. Our guests should arrive at Antalya International Airport (AYT) on the first Sunday. Our customers who cannot come to the airport on the first Sunday cannot join the tour. In this case, the tour reservations of themselves and other guests who have registered for the relevant tour will be cancelled. In this case, our guests cannot demand any refund. For our guests who want to arrive earlier than the first Sunday, the organizational support will be provided by the Touraturk operations manager, depending on the availability of the hotel.

We will be carrying the personal belongings of our customers in our support vehicle. However, all responsibility for these items belongs to our customers who are the owners of the items in question. Touraturk cannot be held responsible for damages, loss or theft of these goods.

There are mobile phone holders and charging units on our motorcycles that our customers will rent. However, our customers are responsible for the safety of their electronic devices and all other personal belongings they have with them. Touraturk cannot be held responsible for any damage, loss or theft caused by the said goods.

Our customers are responsible for the observance of the applicable provisions and laws in terms of his passport, visa, healthcare and driving in Turkey. In case of our customers are not able to start the trip because they are not able to observe such provisions or if they have to cancel it because of such reason, Touraturk will not subject to any responsibility and is not obliged to refund the payments.

By reservation for the tour, our customers declare that they have a valid driving license, which will use for the tour and that they have the relevant riding skills which allow them safe driving of the motor vehicle along the whole route of the tour. If, after the reservation is made, it appears that our customers do not have a valid driving license for the whole duration of the tour, Touraturk will have the right to exclude the customer from the tour and will not be subject to any cancellation rates.

If, after the departure it is found out that our customer does not have the necessary riding skills which would allow them the safe driving of the motor vehicle along the whole route of the tour, Touraturk will have the right to exclude the customer from the tour and will not be subject to any cancellation rates.

Expenses included in the tour price

Motorcycle rental fees reserved by Touraturk customers, fuel costs that motorcycles will consume during the tour, hotel fees for accommodation, lunches and refreshments organized by Touraturk outside the hotel concept, soft drinks and tea and coffee services to be taken at the stopovers planned by Touraturk, Arrival and return airport transfers are included in the tour package price.

Expenses not included in the tour fee

Arrival and return flight tickets of Touraturk customers to Turkey, private health insurance valid within the borders of Turkey and during the tour, in case of any illness, accident and adverse conditions,

 Alcoholic/non-alcoholic beverages consumed outside of the food/beverage concept in the hotel to be accommodated and consumed other than the permitted beverages, all kinds of food and alcoholic/non-alcoholic beverages to be requested outside the hotel or restaurant concept and menu, printed photographs and video recordings made by the company personnel served at the activities or copies in registration, all kinds of service and service fees, traffic fines requested, except for the hotel concepts where accommodation is made, will be paid by our customers themselves.
